Terms of Service

1. Acceptance of Terms

By registering for, accessing, or using HelpMeBuddy (“the Service”), you agree to these Terms of Service (“Terms”) and our Privacy Policy, incorporated herein by reference. If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Help Me Buddy IT Solutions.

2. Description of Service

HelpMeBuddy is an AI-powered advertising and business growth SaaS platform that provides:

• AI-generated ad creatives and campaign management
• Meta (Facebook/Instagram) advertising integration
• WhatsApp Business automation and lead management
• Growth strategy recommendations and analytics
• Landing page builder and lead capture tools
• Client acquisition and engagement tools

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorised use of your account
• Be at least 18 years of age to create an account

You may only create one free workspace per email address. We reserve the right to terminate accounts that violate these Terms.

4. Subscription Plans and Payment

HelpMeBuddy offers a 14-day free trial followed by paid subscription plans.

• All subscription fees are billed in Indian Rupees (INR) via PayU
• Subscriptions auto-renew unless cancelled before the renewal date
• No refunds are provided for partial months of service
• We reserve the right to change pricing with 30 days' notice
• Failure to pay may result in suspension or termination of your account

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Send spam, unsolicited communications, or engage in phishing
• Create deceptive or misleading advertisements
• Infringe on intellectual property rights of others
• Upload malware, viruses, or malicious code
• Attempt to gain unauthorised access to our systems or other accounts
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service for any unlawful, harmful, or fraudulent purpose
• Violate Meta's, Google's, or WhatsApp's platform policies

6. AI Features and Content

Our platform uses OpenAI technology to generate content, strategies, and recommendations. You acknowledge that:

• AI-generated content is provided as-is and may not always be accurate
• You are solely responsible for reviewing and approving any AI-generated content before publishing
• We do not guarantee specific advertising results or ROI
• Content generated using our AI tools may be subject to OpenAI's usage policies

7. Third-Party Integrations

The Service integrates with third-party platforms (Meta, Google, WhatsApp, PayU). Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or conduct of third-party services. Connecting third-party accounts grants us permission to access and use that data as described in our Privacy Policy.

8. Intellectual Property

The Service, including all content, features, and functionality, is owned by Help Me Buddy IT Solutions and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your business purposes. You retain ownership of all data and content you upload to the platform.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACHIEVE ANY PARTICULAR ADVERTISING RESULTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HELP ME BUDDY IT SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM.

11. Termination

You may terminate your account at any time by contacting us at support@helpmebuddy.in. We reserve the right to suspend or terminate your account immediately for violation of these Terms. Upon termination, your right to use the Service ceases and we may delete your account data as described in our Privacy Policy.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Gujarat, India.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page and updating the “Last updated” date. Continued use of the Service after changes constitutes acceptance of the new Terms.
